What is the name of your state (only U.S. law)? IN
I came on here not to long ago asking about what to do with daughter's father who harrasses me etc. (He is not on birth certificate and has not seen her since she was born 8 years ago) I now have a little bit of a problem on my hands and since I got great advice before, I am hoping you may be able to answer some of my questions as the State Attorney of Florida will not return my calls.
In 2004, the state of Florida pressed charges against my ex for stalking my mother. After he exhausted himself by getting no response from me except to have an attorney contact me, he proceded to call my mother's place of employment 20+ times a day, sending 100 pages of faxes with kidnapping posters he made with my daughter's picture on it, statements saying my mother is a drug addict (FAR from the truth) and other horrendous things. My mother called the police and the State ended up pressing charges against him for stalking. He then fled, yet again. He was picked up on severeal warrants a few months ago, one of which was the one for stalking. Since I am not named in the case, the State Attorney said I really have nothing to do with it and that emails etc he sent me cannot be used, but all the other evidence such as poilce reports etc and false child abuse accusations could be used because they were sent out to my mother's home (I lived with her at the time). I explained the background that we had regarding the child.
Ex has been running a website for the past couple years putting horrible things on the web about me kidnapping her etc. Just yesterday he updated the website saying that thanks to this case he was able to find out through DCF my employment records and past home addresses as well as the fact that it was stated in the reports that I moved to Indiana. I am baffled as to how he found out this information? He falsely accused me of child abuse and neglect on several different occasions. Caseworkers came out, inspected my home etc, drug tested me and closed the cases within in a week. But I did have to fill out exstensive paperwork each time.
Aren't these records private? In the last case record the caseworker got an order from the judge that stated he is to have no contact with the child until he seeks to establish paternity in the court, because they were tired of him playing games and abusing the system. Is it possible the Public Defender gave him this information? Is this legal? I'm not even named in the case, why would they be looking up my information and especially since the case involves him stalking and harrassing my mother etc, they give out my personal info to him? They are so many police reports in the case, several which include him ramming his car into mine to run me off the road, one with him hiding behind our house and confronting me when I would come home from work, atleast 9 domestic violence calls etc. I just figured the State would atleast try to protect people, instead they read all this and give him my personal info. Any info would be greatly appreciated.
I have called the prosescuting attorney on this case serveral times, written email and have had no answers. My mother has gotten no nanswers either. If she is giving out or searching records inappropriately, do I have recourse?
