My brother's public defender filed a joint stipulated motion with the county prosector demanding my brother sign over the title of his truck as a stipulation of receiving further public defender service. Judge ruled he created a conflict of interest and dismissed him and ordered return of title to my brother whose truck was impounded, so he could hire his own defense. County prosecutor then filed for forfeiture of truck after judges motion to return it. Brother had no public defender or truck. Contined preliminary hearing again. He was arrested on Feb 4, His arraignment was Feb 7, his preliminary is scheduled for April 6 due to the conflict of interest his public defender created. Is this a violation of his due process? Even tho he had to sign his rights over because he didn't have proper public defender representation?
