Public Intox.

I was arrested in Indiana for Public Intox. I was in the back seat of my sister-in-laws car and yelled something out the window that the officer found offensive. He came up to the car and asked "Who made the smart ass comment?". After discovering it was me, I was handcuffed and thrown into the back of the squad car. The officer never asked if I was drinking, no field sobriety test, no breathalyzer. He just threw me in the car and arrested me for public intox.--no discussinon--no questions asked. How should I proceed? I can't see how the state can prove I was intoxicated.

Anyone that yells at a cop for no reason is either drunk or a peabrain idiot. The cop must have thought that you were not an idiot then.
