Yep! I must have been! If some PIG said I was drunk, then he is OBVIOUSLY right.

I gave him NO inkling I was even drinking BEFORE he approached me.

I did not stumble, I did not slur....

I was minding my own business when the pig arrived to ruin my Saturday evening.

Yeah ... they just drove along and said to themselves, "I think I'll jack that guy up for no reason, tonight."

As i said, there is more to public intoxication than stumbling around.

So, what did the officer write in his report to attempt to justify the contact and the arrest?

More likely, he was a little bored as it was slow for a Saturday night.

Then, he approached me and when he finds out I know what my rights are, his authority becomes threatened.

I am not 100% of the details of the arrest report. I will be looking at it in the coming days.

I've already heard him lie to the prosecutor, saying he "offered me a cab", but I refused!!

Total 100% LIE!!!!!

Since you are so adament about it - lets assume that you weren't drunk.

But you do have an attitude - and sometimes thats all it takes when dealing with an officer who is on the fence as to whether to arrest you or not.

your clearly stating that you did something here to provoke him (whether legal or not); initially you said that he asked you a question and you kept walking. not a good idea.

I am all for exercising my rights; but you can't just walk away from a cop when they ask you something! If you want to stand there and be silent sure; but you cant just walk away.

Public Intox

I got arrested in Iowa for the same crap. I said the F word in a bar and the bartender didn't like it and took my drink that I just paid for. I hadn't taken a sip out of it. When I demanded either my drink back or my money back he said he was calling the cops if I don't leave. I told him to go ahead. Certainly the police will see that he stole my money right? Wrong! I went to jail because I was on the outskirts of a larger city and this little small town wanted some free money out of me. In Iowa it is the law that you must be informed that you have a right to have a sobriety test performed within 2 hours of your arrest at your own expense. No one told me anything. I also plead not guilty. The small town judge was fried. He just wanted his revenue. So now I have a court date. I am sure that small town cop will lie and say that I was informed of my right to get an alcohol test administered to me at my own expense. In Iowa the law reads that even if you simulate intoxication that you are guilty of public intoxication. So basically you better not be exhibiting any behavior at all that they can say, "you act intoxicated" because they need no proof. Several people have taken this to court on appeal saying it violates their first amendment rights. No success. This country violates peoples rights more than any that I know of. People are not free here. I wish I could just flee the United States all together because every state is becoming the same and persecuting the people. If I was intoxicated then the bartender and that bar should be fined or shut down for getting me that way. What a joke. Get people intoxicated and then call the cops on them for being intoxicated.

The doors are open to the north and to the south, so you can just walk off if you like.

While I can't speak to your specific offense, I suspect that the bartender felt you were being a jerk so he refused service to you. If he did not refund your money, you can take him to small claims court.
