I was arrested two days ago for public intoxication in Charlottesville, VA. I was not given a breathalizer test or any other test to determine if I was intoxicated. I have the option of not going to court and paying $67 instead. Two questions:

1. If I go to court, do I have a chance of being cleared of the charges, considering I was not given a test for intoxication?

2. How bad is it to have this on my record? I am planning on applying to law school next Spring. Will this hurt my chances of being accepted?

Any advice would be greatly appreciated.

1.) public intoxication is open to interpretation (spelling?) by the officers. public intoxication is being unable to care for yourself or others. pay the fine and get it over with. i doubt this charge will hurt your carreer options.
