Salem Township, Morrow, OH
Variance was given to neighbor to operate a riding stable. Neighbor is operating a "rent-a-party" place resulting in drinking and music blasting. This is against local zoning rules and what the variance was given to do. Zoning board says is ok because he is exempt from local zoning per Ohio Revised Code #303.01. Asked DA to look into this.
I also asked township board why we were not notified of this zoning request. They said they could not afford to advertise in county paper. I advised them this was illegal per ORC 303.12 and 512.12. They said they posted an ad in local paper that said special mtg by zoning board. I am checking into back issues of this.
Contacted county paper where other townships post Public Legal Notices. The newspaper who owns the county and the local one said for it to be considered a public legal notice, it has to be in the county paper under the heading "Public Legal Notice". The local paper the township used does not contain public legal notices per the newspaper owner.
Contacted other local townships. They charge fee for advertising expenses related to variance request.
Question is: Is the newspaper correct that in order for a public notice to be legal, it must be posted under the heading "Public Legal Notice". I wish to go back to the township with this issue and hope to have correct information when I do.
