We are a Neighborhood Watch Group that would like to know the precedents, case law, or "case histories" of the California Public Health & Safety Law, Title 10, Sections 370 et al., Maintaining a Public Nuisance. In addressing a nuisance home on our block, our contact Sheriff's Deputy was encouraged by the District Attorney to file a case under the above referenced law, but then the DA backed off and wouldn't file. Although the chief DA can not cite any case histories, nor remember any filings under such law, he says the case law supports filing only when there are rats on the property or barking dogs. The wording of the law is quite clear, and the wording certainly does not limit it's use to such situations. We believe the law would be a powerful tool for law enforcement, and can not believe it is not being used. Since we do not have access to proprietary databases as are used by attorneys, and wish to know the precedents and case histories under this law, I am asking for your help. Can you help? Thank you !!
