Public school accountability

We moved from the North to Texas 2 years ago and settled in a small town. During my son’s 1st year in public school, he had trouble with kids spreading false gossip about him. At the end of the year, one child accused him of making a “Kill List” naming other students and teachers.

We took this matter very seriously with our son and school. Our son denied it, and nobody, except for the complaining student (who the school would not name) had ever seen such a note. The complaining student did not have the note but said he had seen our son writing it.

The school sided with the complaining student and disciplined our son. This caused us much ridicule in the town and even led to a confrontation at a little league game by some other parents.

We pulled our son from the school and took him to a school in a neighboring town.

Now 2 years later, he is thriving in the new school academically, socially and in every way imaginable. He started dating a girl at the new school who has a cousin at the old school. His girlfriend told him that kids in the old school still talk about him and now claim that he got kicked out of school for bringing animal pornography to school. In addition, the school kicked out another student last year for similar accusations about a “Kill List”. We have since learned that a third student had problems and sued the school a few years ago. I don’t know the facts or results of the case.

My questions: What can be done to stop the outrageous things being said on school grounds? Does the school have any accountability? Also, we want to obtain our children’s files and documentation of his disciplinary action. Are they obligated to give them to us.

**Start an even more outrageous rumor so the kids forget about your son.

Does the school have any accountability?

**Not unless they are the ones responsible for slander (has to be untrue, unfounded, and w/ malice--likely not the case here).

Also, we want to obtain our children’s files and documentation of his disciplinary action. Are they obligated to give them to us.

**Yes, as parents you have the right to see any and all files on your son.
Sorry to hear about all of this. These are serious allegations that could possibly be true in today's times. Unless you can PROVE these are completely false and said with malice, you have no case. And it is rumors spread by students. You have no grounds to sue the school.
