Puerto Rico Property

Hi.

My father passed away 3 years ago in New Jersey. He owned a house in NJ and one in Puerto Rico. His executor, also his wife from a second marriage, never settled the will in which my brother, sister and I were named.

His wife is now claiming that she gets 1/2 of the Puerto Rico estate based on their laws and that we're only entitled to 1/2 of our portion named in the will. Does anyone know how the laws in Puerto Rico handle division of estates?

What do you mean she never "settled" the will--do you mean that she never submitted it to probate court?

With a matter of this importance, you should not be relying on what SHE says. Do a GOOGLE search on the phrase "Puerto Rico probate attorney" and start consulting with one immediately so you can get a correct answer. Believe me, the widow has consulted with HER attorneys about this.

It was probated in NJ, where he died. We were never notified of the will and called the county clerk in the county where he died and received a copy. That's how we found out about it. We did hire a local lawyer who had to resign the case because he was made a judge. He referred us to another lawyer who is trying to see if it can be settled out of court. We're looking for a third lawyer at this point.

Was the PR property probated in NJ?

The entire estate was under one will, which includes the PR property, therefore it was all probated in NJ.

There has to be action in PR to affect the real estate in PR.

You really need to find an NJ attorney who is also a member of the PR bar. Probably not unusual up there.

Call the NJ state bar and ask them if there is such a lawyer.
