i rent an apt in n.california. Recently my husband and I got into a non violent disagreement and I tried to leave. He would not let me get my stuff. My brother attempted to do so and was already in a bad mood so he hit my husband. He would not stop so I asked the neighbors to call 911.

A few days later we got served a 30-day notice. The manager told me we were being kicked out because they have a no tolerance policy for domestic disturbances. This is not stated anywhere in our rental agreements or policy.

I called the police to protect my husband and I got us kicked out...is that right? Now I am afraid to call the police and I have already had 2 situations where they should have been called and I panicked thinking I would get a 3 day notice.

First and foremost, read your lease throughly. I know that most apt. leases or their rules and regulations state that you are held liable for you guests and their actions (your brother)If this is the case, there is little you can do.

Domestic Violence, no matter how "tame" or how "wild" can get out of control and the property managers have to protect themselves. If you or your husband was killed during a domestic dispute, (by the other) it comes back to the manager as "Why did you not do anything to prevent this" they are held liable in that account. I realize that you said it was non-violent, but not everyone's are. It would be discrimanation if the landlord overlooked your situation but busted other tenants for this, regardless of the situation.
