During a time of marital trouble, my husband signed a purchase agreement with someone to sell them a lot we had in a subdivision. We do live in a community property state. I refused to sign for the sale and explained to the buyers that he did it out of anger, etc. They demanded we go through with it, even though I returned their deposit without ever cashing it. We own another lot in the front of the subdivision and offered them that one, but they refuse to take it. They are trying to run up huge attorney fees and force this sale. Since we have offered them an alternative lot in the same subdivision and they refused it and also didn't try to buy a lot across the street from the original lot when it came up for sale, should we have to go through with this sale?

They can run up all the attorney fees they want. They never had a valid contract if the property his owned by you jointly. They can pursue damages against your husband for the possible misrepresentation that the offer/acceptance was properly executed (i.e., signed by all the owners).

At the first sign of legal action on their part you will need a real estate lawyer of your own.
