What is the name of your state? Georgia--I purchased the software from Texas over the internet.

I ordered some so-called free software over the internet. The webpage indicated that I would be charged around $5 for the software to cover shipping. The invoice I printed out and the confirmation email both said the same thing. The software arrived and I thought all was well. I didn't look over my credit card statement thoroughly that month when I received it and so missed the charge of $40 from this company. The next month I get my statement and see another charge for $40 from this company for another set of software which I never received. I went to their website and after searching I found a sentence buried within their user policy stating that this was a software club and I had to return the CD's within 10 days or I would be charged the full amount. I called the company and told them I wanted the charges removed and that I would return the CD's-they refused. I also told them that I had not received the second set of software that I had been charged for and wanted that charge removed. They said that they would send me the software but would not remove the charge because I had already paid for it. I told them that I didn't want the software and because they hadn't sent it to me I just wanted to cancel and have them remove the charge. They refused and said they would send me the software. I cancelled any further shipments and submitted a charge dispute to my credit card company until this is worked out.

First question: Do I have any options as far as returning the CD's and having the first charge removed or is this just a case of lesson learned-read the fine print next time? Again, nothing was said on the order page, product description or confirmation mail about having to preview the CD's for a certain length of time and then being charged the full amount.

Second question: What are my rights as far as the second charge goes. They charged me for software that I never received so do I have the right to cancel this particular order and have them remove the charge or do I have to accept it. I will, of course, return anything they send to me.

In your situation, I would contact the credit card company and dispute the charges and tell them to not allow that company to charge your card again. There is a big paperwork hassle involved but, in the end, you are likely to win. :D Good luck!
