Purchased Item On Ebay/Not Working

I purchased a car amplifier on EBAY. Advertised as a fully functional item, with the exception of a few scratches on it, nothing was wrong with the amp. Before bidding, I emailed him to ask if there were any defects with the amp. He replied No, the amp is fully functional.

I finally rcv the amp and have it professionally installed. After I'm driving away, no more than 5 minutes away the amp blows a fuse. It does this two more times(same day) while I'm back at CircuitCity. We test a new amp, same model/make, no problems .
The seller is not working with me on this problem, What are my options. I only want a fully funtional amp to connect to my stereo system. Do you think I have a winning small claims court case here? I want my money back, and associated court fees back, or a fully functional amp.

Thanks for the advice, I did get what I paid for. When posting a reply please try to post a response related to the topic, not advice on how to use the website. Obviously the first thing to do is to look for related topics, I found nothing that gave me info on my type of issue.

Then you don't know what you're doing. I know of at least 24 previous posts concerning E-Bay purchases. Try again, using E-Bay as your search term.

IAAL, there have been eBay question before, yes, but sometimes cases differ enough to warrant asking anyway. He bought something that was offered as working, and the seller may really have thought that since it worked for a few minutes. Or the seller may have had that problem before and lied.

Jag, file in small claims. I lean toward the latter, that he had the sme problem before. Either way, you have a broken item.

My response:

CaliCat, you don't know what you're talking about. You think "sue them" or "file in Small Claims" is so damned easy.
And no - - none of the questions about E-Bay are different. There are only questions about someone being dissatisfied or has been cheated, and all of them want to know what to do about it. It's the same old story. We have discussed this issue ad nauseum.

The reason we don't like to respond to people who use E-Bay is because it's stupid to purchase anything across State lines. The cost of going to court in "the other person's State" is cost prohibitive. You don't know anything about law, and you certainly don't know anything about "jurisdiction" or "minimum contacts."

We try to stress that people should stay off of E-Bay due to numerous State lines being crossed, and the fact that if someone is cheated, there's very little, if anything, either party can do about the situation. We try to impress upon people to buy locally, within their own State. That way, the costs are minimal, and jurisdiction is easily satisfied.

But, you don't even understand what I'm talking about because you have no clue about "jurisdiction" or how it works. If you did, you wouldn't be responding as you do.

Your response posts are, for the most part, meaningless because all you know how to say is "sue them in Small Claims". That's not all there is to it. But, you seem to think so.

Here is what I don't understand, you're annoyed with these postings, yet you go through the trouble of reading them, and responding to them. If they are a waste of your time, DONT RESPOND. Seems simple, instead you want to waste our time by responding with your useless two cents.

i beleive items sold on ebay are sold as is unless stated otherwise. So he may be stuck with the bad amp. thats why i dont shop on e-bay==its not worth the risk that something is wrong with what you buy.
