Okay, here is the story:
We placed an order with a distributor for some parts, back in November. Last Monday, they call and say the backordered parts are available, and will be shipped that day. Great, they ship, and are delivered 2 days later. They bill our credit line (with them) for the parts.
We then deliver the products to our customer for whom we'd placed the original backorder, and bill our customer based on the prices we paid from our supplier.
Fast forward 2 days - Our supplier has credited our line for the original purchases, then REBILLED us for a much higher amount - $50 additional for each line item. This is a $5,000 upcharge, AFTER the product has already been delivered. They did not contact us, we did not agree, they just billed us without saying anything.
So I call them, and they say that they manufacturer raised thier prices back in December, so they had to pass the price increases on to us.
Now, I talked to the FTC and they said they shouldn't be billing us the difference, since our original order was at the lower price, we were billed the lower price (I have invoices to prove it) and goods were delivered at the lower price. They simply tried to bill us for the higher amount, after goods had been delivered, without telling us.
Is that even remotely legal??
