I work for an Financial Institution in NJ. Over the past four months we have a male emlpoyee that has repeatedly committed acts of "gross misconduct". This employee has broken "Workplace Rules" many times, he has been "Written Up" for various reasons, but still he has not been terminated. This person has a history known throughout the company as a "Romeo" or "Womanizer". He has carried on numerous office affairs and had caused ill feelings and divisions among managers and co-workers. In February this person was accused of Sexual harassment". It was concluded that the relationship was "Consensual", however I think it will still remain in his file that a complaint was made. This person was even suspended in April (three days) for misuse of the Company owned Computer. But still he always comes back, he is not even a good worker. Previously, he was a department manager, but his position was yanked after allegations of Sex harassment began. He is now just a regular office employee. Our department manager (Female) does not like him in the least and constantly gives him a hard time. For the most part the entire office feels some animosity toward him for his actions over these past months. I know that Companies have policies, could it be that the company just does not have enough against him yet to terminate. Eventhough, this employee has violated many rules and policies do they still have to make sure that they have enough in his file before terminating his employment. do you feel the company is afraid of "Law Suits" Wrongful termination" claims etc?? At times it seems the Company is more concerned with the rights of this male employee, than the rights and welfare of the rest of the co-workers. In all reality, any one else would have been sent packing long ago for this type of conduct. This employee has been with my company for 15 Months. Any insight or advice woud be helpful..Thank you....

We can't possibly know what your employer's reasoning is. A wrongful termination means a termination that violates the law; there certainly doesn't seem to be any reason to believe the employee would have any kind of a valid wrongful term case. But there may be other reasons (perhaps political) that stays their hand.
