In 1982 I was injured in an alcohol related automobile accident in Louisiana. My spinal cord was fractured and I'm a C 1-2 quadriplegic and I also depend on a respirator to breathe for me. The driver was charged with DWI, but I decided to drop the charges. My father acted as my power of attorney and my lawyer settled a lawsuit with the driver's auto insurance company because the driver had no assets. I don't know the specifics of the contract. Since the driver currently holds a vast amount of equity can I seek another suit for the physical and emotional turmoil I've suffered the last 18 years?

You may be barred because of the statute of limitations in combination with the previous settlement. I am not sure if your case can be reopened. To see if there are any loopholes, please contact all of these resources.

1. Your state bar association and ask for some upfront advice. Maybe they can help you.

3. City hall and ask for some consumer groups/consumer rights groups. They might know something.

Just wondered if you had any contact with the spinal cord society in your state?
sometimes they can be a helpful resource center and point you in the right direction for advice.
