What is the name of your state (only U.S. law)? NJ

I am a nurse practitioner who graduated in 2009. I applied to X company (doing retail clinic) in 2010, interviewed with hiring manager Stephanie and was told I did not have enough experience. I subsequently worked in oncology, family practice and home care throughout the years. I applied to X company at least once a year, hoping then I have enough experience to work for them. Nope, rejected every time. In 2012, I was hired by Y company (for a retail clinic). I applied to X company again in 2013 for per diem work. Stephanie replied 'although your accomplishments and background were of interest, we have decided to pursue other candidates who more closely meet the company needs'. I wish I knew what those needs were that was so difficult to provide!. Meanwhile, I am still getting ads from the same company hiring in my area. I went to see if X company would hire me in another state. I passed my first interview yesterday. Is there any legal action I can take against Stephanie?

You can't sue her for not hiring you. There's no law that says a company has to hire someone if that person meets the criteria of the open position. This is America. Companies are free to hire and not hire pretty much anyone they want. Stephanie obviously feels you would not be a good fit so move on.
 
yeah nothing you can do about it, I have selling experience selling a competitive product and producing millions of dollars of revenue. I can not make another competitor hire me just because I want to work for them. They have an idea of who they want, you have an idea of what you want. A lot of times those two ideas do not meet or equal one another.

Of course you can't pursue any legal action against anyone! Do you really think you're the only qualified candidate they heard from? What's so special about you that you think they're legally obligated to hire you?

Grow up.

damn, I meet the requirements to be president of the usa but have never been elected. I was going to sue everybody that didn't vote for me (which would be everybody in the country) for not electing me.

unless they did not hire you based on a protected class of persons you belong to (race, religion, over 40, etc,), there is nothing illegal about hiring somebody else...ANYBODY ELSE, no matter if they are qualified or not, over you. They have the legal right to hire or not hire anybody they choose.

Given that the thread even exists, I'm sure Stephanie is not just happy but relieved, she didn't hire the OP.

They appear to have dodged a bullet.
 
Yeah, you could be the only person that keeps applying to them and they still don't have to hire you or even give you a reason for that matter.

I am just a person looking for work, and dont know any better when it comes to hiring issues. I come here looking for help and advice. To compare this to becoming the president of the US is just stupid

apparently you don't understand rhetoric and hyperbole.

the point was: people and businesses get to make their own decisions. Unless that decision is limited by law, there is nothing you can do about it. If you notice, along with the comment about being president, I did give you some information that apparently you considered worthwhile seeing that you mentioned it in this last post.

but just because you are a minority doesn't mean you were discriminated against. To start with, review what you can about their employee make up. If you can find employees of the same minority in a ratio similar to the general make up in your area, it is unlikely you were discriminated against for that reason.


it could be as simple as; there is something they don't like about you or your work history. Some things you may never know because generally there is no requirement they disclose why they didn't hire you to anybody.

but I have no idea what smh is supposed to refer to but that and ppl, if used in any communications with the prospective employer might be part of why they didn't hire you. Just something for you to review about yourself. Not saying that is the problem.

They're not required to hire you just because you're a minority, either. (BTW, doing so would be just as illegal as NOT hiring you because you're a minority)

Do you have any EVIDENCE that you definitely would have been hired but for your race/gender/religion/whathaveyou?
