Question About Conflict Of Interest

1. Attorney serves as a City Commissioner in a quasi-judicial board whose decisions regarding permits, licenses, and other use entitlements are final. Any further grievances must be filed in Superior Court.

2. Attorney voted and decided the fate of a certain project( to be referred to as “A”). It was determined later that false information was provided by the city regarding “Project A”. However, the vote was final and cannot be reversed.

3. City Official is arrested for bribery, corruption, insurance fraud, etc. It is determined that City Official’s actions regarding “Project A” led to City Official’s arrest.

4. Attorney is hired as City Official’s criminal defense lawyer.

5. City Official can no longer afford Attorney’s legal bill. Conflict arises when City Official is required to be represented by Public Defender.

6. Attorney continues to serve as City Official’s defense lawyer with his legal fees now paid for by taxpayers.

Is it a Conflict of Interest to represent City Official when the Attorney decided the fate of “Project A” in which City Official’s actions led to his arrest? I should also note that Attorney’s vote in “Project A” is considered by many to be questionable and unjustified.

Can somebody give me the code if it is a conflict of interest? And who enforces these conflicts? Is it the State Bar?
