What is the name of your state (only U.S. law)? CA
I am a general contractor. I recently completed a project on a private SFD per the terms of the contract. However, I also completed additional work requested by the homeowner that I did not obtain signed authorization for. I realize how foolish that was.
Due to issues the homeowner has with the additional work, he has withheld final payment until we resolve. I have an attorney advising me in the resolution, but I have a question regarding a statement the homeowner made.
Is there a statute of any kind in California Law that allows a customer to withhhold 20% (twenty percent) for sixty days? The homeowner has told me he intends to hold back 20% for at least sixty days.
Additional note; the homeowner already paid for all additional change orders. They were included as separate line items on invoice that have been paid for during the course of the project. The actual final invoice is for the final 20% of the original invoice only.
