question about getting a tutor

What is the name of your state (only U.S. law)? New York
I am the parent of a 16 year old son who was diagonesed with a mild cass of Tourettes about 6 months ago. On May 7 he was suspended form school until Tuesday May 10. At first we were told to come in for a meeting on May 10 but I recieved a phone call stating that something elese has come up and could I please come in I do and i am told the school has a detective looking into what was said by other students and that the school will call me back on Wednesday. I never recieve a call so I go to school Thursday and talk with the principal and he says they have found nothing and he and the detective seem to be playing phone tag but my son can still not return to school. Friday I recieve another call from the principal and he says that on Monday my son and myself can come in for a meeting and he should be back into school that day. Saturday I get another phone call saying that until we have our son reevlulated he can not come back to school so the meeting for Monday is off. I have asked for a tutor since day one and today May 17 I asked again and was told that until he was reevuatted the school can not get him a tutor. I am not sure what to do my son was told not to come to school yet he can participate in a school function. Thank you for your time

Is your son on an IEP? Does he have an evaluation for the special education program? If yes, the school needs to be providing him the tutor or they are in violation of the law.

If there is no tutor listed in the IEP, then you do need to get him evaluated and start getting services. What did the doctor who diagnosed him tell you? Did they give you any information?

Is your son in trouble at school? If you are trying to "get him out of trouble" by claiming he should have had a tutor, that won't work. If he violated the school's code of conduct, he will still be responsible.

Is he back in school today?

suspended for two days and then when we were told he could return to school the school said that he could not because they heard rumors that are untrue.He is not back in school today. The dr that diagonsed him has stated that because of his disease he may say things he does not mean and I have given the school a copy of this. We have been in councling and have seen several doctors even before this incident. I have been able to go to school to pick up and drop off work but with final exams coming up I feel it necessary for a tutor since he is misssing a lot of review.He does not have an IEP he did when he was in public school but the private school he is in does not follow IEP so for the last two years he has been mainstreamed.

So, because of the Tourettes, he said something inappropriate? What did he say (minus any swear words).

Why did you leave public school, and go to private? He would receive more services in public school, where they would provide people who could work with his disability. I don't think it's likely the private school will provide a tutor - that will most likely be left in your hands.

He told another student he would like to see him burn and then told him he know of some people who were having some bonfires and he would like to see that person come. My son onlysaid this after the other boy said to him to have his teacher get a picture of him tatooed to his private parts.I aplogize for this last statement but it was the best way to say it.
My husband,myself and our son along with some other family memebers thought that he would be getting a better education at a private high school. We also thought since there are many less students in a private school we would not have such problems. We are now disuussing putting him back into a public school for his last two years of high school. again thank you

Thank you for the explanation. That issue with the other student becomes a public safety type of issue. Your son would HAVE to be kept out of school if there were any threat of violence.

I can understand you thinking he would receive better education in a private school, but in a case where a student needs to have services through a school psychologist or special education department (not that he is learning disabled, but that he needs an IEP) - public schools have the funds and means to do this. Once you get him back into public school, set up an ARD - this is a meeting where a specific plan of action can be discussed to get your son on the right track to graduate.
