Question about Legal doc. vs. verbal agreement in court

ok guys i have a quick question...i am the sole name on a legal lease document....now my now ex girlfriend has been living here and she has never been on any lease nor does she have her name on any utilities for the home...she has quite frankly made me crazy and i do not want her to be living there anymore...Now since i have legal documents with my name only on them for the home do i have the right to evict her as we have always only had a verbal contract to live here. or am i in the wrong....When she did what she did and i will not go into it but it was bad she believes that her verbal contract with me will hold up in court against my legal lease document and my utilities..I beleve that her staying there will decrease my mental stability...cani give her a 60 day verbal notice followed up with a legal document of eviction and get her out of my home?

My response:

Change the locks. Let her prove that she ever lived there at all!

And, don't forget - - remove any trace of her ever having lived there.

well she actually has alot of stuff to move out and without a place i just cant put it outside....i dotn want to be cold hearted just want her to get out. i was always told that a legal document is and will always beat a verbal agreement in court...she dosent believe this...Also she doe have mail coming to the house she has been here since 2003 so i just want this to end so i dont end up going crazy.

My response:

It sure would have been nice if you put these NEW fact in your original post. You made it sound like she had only lived there for a few months, at most.

If she wants to rely on a "verbal agreement" then tell her, "Okay, here's your written 3-day Notice to Pay Rent or Quit". And, when she fails to pay her "verbally agreed" $1,000.00 for the month of January, you tell her: "Okay, I'll just file an Unlawful Detainer action against you, and when I win, I'll have the Sheriff's Deputy throw you out, bodily."

How's that for turning the tables?
