What is the name of your state (only U.S. law)? Tennessee, reside in NC but son lives in TN with his mother.

At the last court date, judge ordered our case to go to mediation. My attorney set it up and we were both mailed a letter of the date and time and cost. The mom has now informed me that she is unable to pay her portion of it and assumes it will go back to court on Jan 25th 2010. If she does not show or if she does show and cannot pay her portion at the time, what happens?

There is no court order in place.

Thank you for any advice given.
