question about movin out of state...

What is the name of your state? WA

My ex-wife keeps telling me that in a year, she plans on moving from where i live in Washington to Connecticutt. I have a parenting plan and see my kids everyother weekend and as often as i can. There is no provision in the parenting plan saying she couldnt move=but there should be something i can do. Is there anything I can do to stop the move? I know there might be something i might have to sign to authorize it--so what if i dont authorize it? I dont believe a judge will think its in the best interest of the children to move so far away. Any input?

You can contest the move in court. She would need to prove that the move is in the best interests of the children and that it would not interfere with the current relationship between you and the children. If you are spending as much time as possible with the children, she would most likely not be allowed to move with the kids. You could either petition the court to modify the current agreement to include a move away clause or you could wait until she formally notifies you and contest the move. Personally, I would go with option #1.

How would i go about petitioning the court to modify the current agreement to include a move away clause? Would she have to know about it?

The 6th section has all of the necessary forms pertaining to relocation. According to the state website, you can call the court that issued the original order to find out which form is the right one for your situation or to find out if there is a county specific form you need to file.

Mom will have to be notified of any court actions.
