I have a bill in collection which the collection company keeps pressuring me to pay amounts that I can not afford. They have set up several payments to be drawn out of my savings that have come back NSF. The payments were post dated weeks in advance and I told them I may not have the money because the payments were too high. Now after four of the payments have not gone thru they are theatening legal action if I don't pay the $1100(the total of the four times the account came back NSF) The company collecting the debt is in New Jersey and I heard there was a law about NSF and legal action across state lines.What is the law? Also do I have right to pay the amount I can afford? I have no problem paying the debt I can afford $150 to $200 a month. I cannot afford 300 to 350 a month. Thanks for any advice you can give me.
 


Stop it...

First of all, never, ever give a CA access to your bank accounts...don't do postdated checks, don't do check by phone. These guys can't be trusted to do as they say. Close that account immediately, and bank elsewhere. CAs have been know to "kite" checks, and deposit postdated checks prematurely. Put a stop to it now.

Then, send them a debt validation letter including wording that says that all further contact must be in writing. On the phone, they'll try to intimidate you into doing things you don't have to...and, if they don't intend to take you to court, they've already broken the law.
