Hi- I have a question in regards to a lien put on home my husband co-owned with his mother. My husband purchased a home years ago for his mother when she came to America. It had both hers and his names on it. She then brought her husband here and the 2 of them lived in the house. About 4 years ago he became ill and had to go into a nursing home. The nursing home kept saying they couldn't get him medical assistance because he had no proof he was here legally (even though they had his green card and passport). They went back and forth for 2 years - and ended up putting on a lien on the home my mother-in-law and husband owned (still with mortgage - not paid off). I finally had to get him on medical assistance myself. When I spoke to the lawyer about my father-in-law not being an owner of the home he said because he and my MIL were married they could legally put a lien on the home. He said if she were to pass away, that lien could come off. My MIL passed away on 2011 - and we want to sell the home (no money will be made as home is worth less than monies owed on it). Is it true that this lien can come off? If so, what would need to be done? Thank you in advance for your help!!

Senior Member
Presumably, the lien will need to be paid off so the title can transfer. It will then be removed. No title company will cover a buyer until it is done.

Hi Ladyback1 - the realtor just asked me yesterday to see the judgment - as they asked the same question as you. We are not sure as we never received notice of anything much less the judgment. I called our courthouse today - my husband will have to go there next Wednesday when he off to get a copy of it to see what it says. Thank you for responding.
