California...

Me and my wife separated back in August, during the time we were married I used marijuana and had a doctors reccomendation (medical marijuana card)

Upon separation she was very upset with me and requested temporary custody and stated that my house was unsafe because there were drug users there and she wanted me drug tested before I was granted visitation right....there are no drug users in my house and my wife admitted she put that down simply cause she was hurt emotionally

The day we separated I quit using marijuana and have been 100% clean since, we have a mediation hearing in December, since our separation me and my wife have been hashing things out and have come to a temporary 50/50 visitation agreement and she understands that I have not used marijuana since we separated

My first question is that if she or a judge happens to bring it up should i be completely honest about my past marijuana use?

Second question is I know its up to a judge to ultimately decide whats best for my son, how big of an impact would this situation have on my case?

Your wife is going to need more than your 100% legal use of medical marijuana during your marriage to abrogate your parental rights to visitation with your children.

Of course you should be honest about the marijuana use, anything else is perjury.

Yeah I guess the question about being honest was pretty silly, I sort of knew the answer before I asked

Another question I have is...if my wife doesn't bring it up is there a strong likely hood the mediator or a judge will bring it up since my wife listed it on her request for temporary orders?
