question about state laws.

What is the name of your state? AZ
I have a friend who is going thru a divorce. Her soon to be ex husband is being really difficult. I am aware of community property, but he is demanding that a car that was purchased after marraige be returned to him as well as the rings. We did have a sheriff escort to their old house to get her stuff, and the sheriff said that he had every right to take the car back. Is that true? also, she has a handgun that the husband had a friend hold because due to legal issues, he was not allowed to have them in the house. he refuses to get the firearm and the sheriff also said that that would be a civil matter,to be taken up in court, but this was purchased outside of marriage. what are our rights regarding thisd issue?

They have equal rights to the car....she doesn't have to give it back to him until/unless a judge says she must. If the handgun is registered in her name, she should report it stolen so as to avoid any liability in relationship to the gun...otherwise, forget about it. She should tell him to "pound sand" regarding the rings.

so even though the car is solely in his name, since it was purchased post-marraige, it is still community property? sorry, just want clarification.

If it was purchased during the marriage its community property.
