Taped phone conversations: I read your post from March 15, 2000 and wondered if you could explain something to a lay person. If you said that phone conversations could be liable in custody hearings, where can I look for the privacy act in Texas. My daughter's ex taped her and is threatening to use them in court unless she agrees to what he wants. At present, he is still not a citizen of the United States, has been proven to be involved in family violence and currently has been ordered only supervised visitation with the children. I am concerned that what was said in these conversations would be detremental to her case. They both threatened each other but I am aware enough to know that you can make things look any way that you need them to look.

My response:

Let him threaten all he wants. Seriously, let him do more recording, and let him think he can use it. Your daughter and her attorney will turn the tables on this little "foreign invader" in court, and get him deported in the bargain, on felony charges. Ignorance of the law is not an excuse or a defense.

Watch this:

Texas law is one of the most stringent States when it comes to wiretapping. Here's the law:

Sec. 16.02 (1995) Criminal: 2-20 years & up to $10,000 fine/restitution. Civil: greater of actual damages, $100/day of violation or $10,000; punitive damages; attorney's fees and litigation costs.

So, BLAST him out of the water with that !!
He's screwed !!

Thanks-you made me happy. I have been racked with worry over this. Unfortunately her lawyer is such a wimp and his is a 6 foot female, 250 lb. parauna. Thanks again.
