My response:
It "may" go to court because you were negligent. If your insurance company refuses to settle, or settle for an amount that is satisfactory, with the injured driver, then the claim will most likely go into the litigation process.
It works by letting your insurance company appoint a defense attorney, hired by them, for you to handle the defense of your case. Since you are paying insurance premiums, you are entitled to a defense attorney at no further cost to you. However, win, lose, or draw, your insurance premiums may, in fact, get increased as a result of this matter.
