Question on Relocating

What is the name of your state? VA

Can I legally move within my state of VA without the permission of my childrens' father? We'd like to move from our rural home to a bigger city a few years down the road, and I didn't know what to expect when it comes to the father's rights.

I moved to NC with my oldest daughter 8 years ago, and her father tried to stop me, and our judge told him that since we were never married then I could move where ever I chose, and he would have to make arrangements to visit with her. I wonder if that still holds true 8 years later?

So, HAS he filed for and established visitation since 8 years ago? Where does dad live? If the move would interfere with any court ordered visitation schedule, then dad would have a right to object, and you may end up being responsible for any additional travel expenses the move creates, and will need to modify visitation.

He still has the same visitation that he had 8 years ago. We go to court on the 15th of Sept. for custody, etc. We don't intend on moving anytime soon. Just wanted to know what I could be up against if and when we decide to. I'd love to move out of state, but I couldn't ever do that to my kids...they love their father, and it doesn't matter what differences he and I have!

Any new court orders will likely reflect VA code: written notification to the other party & the courts 30 prior to any change in address or telephone number.

Check out the laws for VA regarding relocation. Many states allow you to move a certain distance, within the state, without the permission of the other parent or the courts. See if yours is one of them, and then you will know the parameters.
