My husband has court ordered visitation with his daughter, but the mother is not allowing him to see her. It has been a huge battle for him to see her on a regular schedule. It is only when the mother sees fit. We will go weeks, if not months, at a time not seeing her. No phone calls are ever accepted. Sometimes he will get an answering machine, but no one ever returns his message. He went to court July '04 and was officially granted visitation. The child is 8 years old. He had her for three weeks during the summer and every other weekend until the weekend before Christmas. It has been almost two months since he has seen his daughter. Should he file for contempt of court? What will be done if the mother is found in contempt? What is the reality of a father obtaining custody of his child when it involves emotional abuse?
 


Yes, you should file contempt. But it would probably be a good idea to have documentation of the denied visits. When is the next visit scheduled for? Try sending a certified letter of Notice of Intent to Exercise Visitation. You can find out about that here:

Yes, he should file for contempt. Even if this contempt is disallowed, the charges can stack up and Judges hate that stuff.

She will be given the opportunity to purge herself of the contempt by giving him his visitation or she can be fined or even more.
What is the reality of a father obtaining custody of his child when it involves emotional abuse?
My husband obtained custody of his then 6 yo daughter due to contempt charges and emotional issues. He hadn't been allowed contact with her in over a year and the contempt charges just kept right on stacking up on his ex-wife's name.

What would be an acceptable way to document denied visitation? I checked the website, but didn't find anything.

Someone could go with him for the p/u (it would be best if it was not someone in the middle of the situation - and a video camera is never a bad idea). When she refuses, he could call the cops to have a report written up. He should also make sure that he follows the order to the letter regarding any required notice, etc.
