What is the name of your state? NJ

My mother passed away in jan. 2005 because of malpractice. My stepfather has a lawsuit against the doctor and his insurance company. If any money is awarded, do myself and my sister have any legal right to said money. We don't know if there was a will ever setup for my mother and it still is kind of a touchy subject with my stepfather.

Who's the plaintiff your stepfather or the estate of your mother?

You've just answered your own question. The settlement will be made out to the estate of your mother and distributed according to her will or intestate succession - except any award for loss of consortium which is stepdad's money.
