Last night my son went to a local sandwich shop. A couple of hours later we had a visit from the cops. Apparently they thought my son deposited needles (heroin) in their bathroom. He has been to this place twice, last night and the night before. He bought dinner and he also used their restroom. The cops made him show them his arms looking for needle tracks. He absolutely does not do drugs! Why they accused him of this is baffling. He is a full time college student and has a full time job. He's a hard worker who takes care of himself and he does not do abuse drugs. They told the cops he cannot come back to this place and if he does he will be arrested. This is screwy to me and to my son. He plans on speaking with the police again today.

I feel what this place did was so wrong. They said he seemed "out of it." He was probably in the place for 10 minutes, if that.

Can anything be done in a case like this?

Yes, your son can find another place to eat.
What would you LIKE to be done? It seems to me that the system worked exactly as it should.

Yes, obviously, he can eat at another place and he will. But he did nothing wrong. Why should he be arrested if he went back there? Is that how the system should work?

Your son might have been confused with someone else who deposited needles in the restroom. Perhaps the needle-deposit was done two nights in a row on the same two nights your son chose to eat there and the connection was made.

But, whether the connection made between your son and the needles was a false one or not, since the restaurant did not accuse him of using drugs or depositing needles in the restroom while he was in the restaurant, and there is no indication that the restaurant owner, or whoever called the police, mentioned their suspicions about your son to anyone but the police, there is no actionable defamation here.

Your son just needs to find another place to eat.
