What is the name of your state (only U.S. law)? Texas

My orders for Christmas state my ex husband is to give me written notice of his travel arrangments to excercise his christmas holiday.

"IT IS ORDERED AND DECREED that XXX shall provide written notice to XXX by November 1st of each year stating the travel arrangements for the children for his Christmas possession schedule."

I recieved a letter on 10/30/09 and it is not in his handwriting. ( I have something to compare it to) My ex husband is in Las Vegas Neveda working and has not seen his kids since 08/07/09. The letter states the following

"I am writing this letter in regards to my christmas visitation. per the court order I am entitled to pick up my children XX & XXx@ 6pm on 12/23 and I wll return them on 12/30/2009"



This letter speaks nothing of the travel arrangments. Which is okay because we now live with in a mile of each other. I called him and left him a message saying I had recieved his letter and it was clear it was not in his handwriting. I am not going to deny his visits, but I am curiouse as to who wrote this letter and if it will stand up in court because it is not his handwriting.

Also just read over this order with a fine tooth comb and our order mentions nothing of another compotent adult picking up the children. I know he is working in Las Vegas and I am concerned someone else will come to pick them up and he will not be there at all for the 7 days becuase he has not been home the last 3 months. What do I do in a case like this?

The order does not say it has to be in his handwriting. Does the order say HE has to pick up the children?

Okay Angela, the fact that you have decided to put real names all over the internet is not cool. Secondly, unless you are a professional hand writing analyst it is none of your business how he wrote it or who wrote it. You have received notice and that is all that matters. He gets his time. You do nothing until AFTER he takes his time and doesn't spend time with the children. You don't get to make the rules. What does the order state regarding transportation? WORD FOR WORD. Because most likely dad can send a competent adult (known to both you and the children) to pick up the children for his time.

Actually I looked all thru the orders looking for the compotent clause that is in my husbands orders and did not find anything.

This is what it says for Weekends

It is ordered and decreed that SRW shall have the right to possession of the children not more then one weekend per month of SRW choice begining at 6pm on Friday and ending at 6pm on Sunday. It is ordered and decreed that the weekend possession shall take place only in Bastrop or Travis county Texas. It is ordered and decreed that SRW shall provide 24 hour notice to ASF of his intent to excercise his weekend possession of the children. It is ordered and decreed that SRW shall be responsible for 100% of the travel expenses.

Summer possession: It is ordered and decreed that SRW shall have possession of the children for two weeks in the summer. It is ordered and decreed that the parties shall split the travel expenses ( 50 % to be paid by each) for the cost of travel for the children for the visitation. It is ordered and decreed that SRW shall provide written notice to ASF by april 1st of each year stateing the two weeks he would like to have for the summer possession. It is orderd and decreed that SRW shall make the travel arrangments for the children in with in 2 days of those arrangments provide written notice to ASF

christmas possession: For the christmas holiday it is ordered and decreed that SRW shall have possession of the children as follows

ODD NUMBERED YEARS: SRW shall have possession of the children begining at 6pm 12/23 untill 6pm 12/30

EVEN NUMBERED YEARS: SRW shall have possession of the children begingng at 6pm 12/16 to 6pm on 12/23

It is ordered and decreed that the parties shall split the travel expenses ( 50% to be paid by each) for the childrens visitation. It is ordered and decreed SRW shall make all the travel arrangments for the children for his christmas possession. It is ordered and decreed that SRW shall provide written notice to ASF by 11/01 of each year stateing the travel arrangments for the children for his christmas possession.

Then it goes into childsupport. This is all there is for possession orderes theres nothing about " either parent may designate any compotent adult to pick up and return the child as applicable. A parent or a designated compotent adult shall be present when the child is picked up or returned." This is not in our order at all
