What is the name of your state? Florida

TBI survivor bad memory and balance etc. Recently in accident another minor head injury. Can the police question you and use it as evidence prior to you being transported to the hospital if you have documentable brain injuries. Where is the line drawn on incompatency? Thanks :confused:

If you're trying to suppress incriminating statements ("I just had 12 beers") it depends on a lot of factors, including whether or not you were in custody when the statements were given, whether they were in response to questions, and whether the police told you your rights ("You have the right to remain silent... etc").

If you're worried about how you acted, or what you looked like, that can't be suppressed, although your lawyer may be able to explain it.

Incompetence to stand trial depends on two factors: 1. whether you can understand the proceedings against you (what a judge is, what a jury does), and whether you can communicate with your attorney.

Hmmm

Really woried about the way I walk and talk normally ...Not to mention after midnight after being up 16 hours and being grilled after having been punched out by an airbag. IMy memory does prett good therefor I dont have abig problem telling thingd the way they are howabout three beers a fish sandwich and a heck of a blow from an airbag and then a gaurdrail at 60 mph. As great as airbagd are they are incompacitating when they deploy.
