It is a long story but I will shorten it up as good as I can. I married my ex-husband when I was very young because we had a daughter together. The marriage ended 7months latter because of verbal and physical abuse on his part. I didnt want to raise my daughter in that enviroment. I remarried when my daughter was 3 although her step-dad has been around since she was 2. She is now 12. She considers her step-dad as her dad. My ex-husband hasnt been there for her the way he should since the day she was born. He never took care of her on his own, he would get help from his mom or my friend. When we were divorced and she would go with him for the weekend, she would really end up spending the weekend with her grandparents.

Ex ended up having 5 kids with 4 different women, my child being the first. He married the last woman and that period of time was the only time he actually had our child at his house. Of course his wife took care of her. Child support was very sketchy with several years of nothing. then 2 years ago he started paying the minimum amount due to keep his drivers license so he could actually get a job. he pays $50 plus an extra $10 for back support a month with the child support unit under the assumption he has no income. About 4 years ago his parents had him committed to the mental ward for the weekend. he came out, left his wife for a couple weeks then came back home. For a long list of reasons their apartment was searched and drug paraphenilia was found. They were then being investigated by CINA.

My daughters therapist recommended she not go for her weekend visits during the investigation because I would be investigated too for endangering my child. I filed for supervised visits at that point and was awarded them based on ex not fighting it. It was up to him to schedule and pay for the visits, he hasnt done a single one. So for the last 4 years and 3 months, ex has not seen his daughter. And for the last year and 7 months he hasnt spoken with her either. And not because of me not letting him, he just hasnt called and neither has his family. They have even ignored her on her birthdays, and Christmas. he has however continued to have his wages garnished for $27.69 every two weeks.

I decided to file for termination of his parental rights. My husband has wanted to adopt my daughter for years and my daughter also wants it very badly. I was wondering if anyone knew how hard of a battle this is going to be as my ex is contesting it. Thank you.

If he is contesting it, it can be a very hard battle because you have to prove him LEGALLY unfit.
