We are currently renting a house with a 1 year lease in upstate New York. The lease expires on Oct.31, 2001 My questions are these:
1. The roof has started to leak and is dripping down through the walls and coming out of a ceiling light fixture. The foundation is cracked and just starting to crumble and whenever it rains, it is leaking through the cracks. We are always cleaning up standing water in the basement. Landlord has been informed. Are these considered hazards and how long do we have to wait for these repairs to be made? Also, there is mold everywhere where it is leaking.
2. We were just informed that landlord is trying to sell property. Under right to privacy and quiet enjoyment, how much access do we have to allow for the showing of the house? Lease states in one paragraph that landlord can only show property within last 30 days of lease. Seven paragraphs later, states can show at will. Which do we follow? We offered a 4 hour period of time one day a week and landlord now showing up whenever he has a potental buyer. We informed landlord that one of us has to be present during all showings(because of pets and guard dog.)
3. Whose responibility is it to keep house and property in "Show" condition? House is neat, clean and orderly, so is property...Landlord insisting that we mow the lawn before all showings(receiving haressing phone calls). We usually mow once a week weather permitting.
4. What happens to the lease once the property is sold?
5. Property is not legally owned by landlord, everything in fathers name, except our lease which is signed by landlord. We were told by landlord that he had power of attorny but were not shown anything in writing. If he has no power of attorney, what does that do to our lease?
We have put all of this in the hands of our attorney but he is in court all week and dont expect a speedy response. Any knowledgable responses here would be greatly appreciated. Thank you

As long as you have a lawyer then ..take pictures of the leaks, the mold etc ... Buy a couple of disposable cameras

It seems like the landlord wants to dump the property on someone before he has to put any money into it.

Which might be good for you, since the new owner gets your lease and your security deposit in the sale, and the new owner will have to pay you to move if they want to break the lease.

But then again roof repairs, and basement are NOT minor repairs

So maybe its a good idea to see if you can get your lawyer to make a deal with the landlord to use the security for your next months rent and move by july 31st....then you wont have to put up with any construction...or potential buyers
