What is the name of your state? GA

What amount of time must one wait to go back to court for child support amendment issues after divorce is final?

Also, when one spouse takes the other back to court after 5 years asking for an increase in child support, is the salary of custodial parent (mother) taken into consideration as well as the father? Especially if mother's is significantly greater.

It's state-specific and I'm not sure what GA bases CS on, offhand. Normally, there either needs to be a significant change in circumstance or a period of time passed. If GA uses a shared income model, than both parents' incomes will be included in the calculation.
 
Under that link that VeronicaGia posted, it also states under the support order establishment #12, that the custodial parents income is calculated also.. :confused:

That link was great.. it answered some questions I had too!

Hmmmm, yes I see it now.

Sounds like the #12 applies to when CS is first established, and the other is for modification. Seems to me they would work the same way.

Anyone else have any thoughts on this?

GA child support

Ga law ONLY looks at the income of the NCP. Even if the CP makes alot more, it really doesn't matter. The law states that both parties income is to be listed in the papers, but when it comes to the child support amount to be paid by the ncp, only that income is considered. Please note the key word is LISTED in the final order. It doesn't "consider" the cp's income and use that figure in listing child support. It just has to put it in the papers because the ncp's income is also listed.
