I am currently developing a video game and would like to use an idea from a tv show called Rugrats. The specific quote is "Satchmo? The trumpet player? No, the Monster!" The kids were trying to say Sasquatch but instead said Satchmo. The idea I have is to have a Bigfoot like monster carrying a trumpet and call it Satchmo. Is this copyright infringement? Thank you!
Short quotes are rarely creative and original enough to qualify for copyright protection on their own, although the show's script is copyright-protected. Whether the use of the quote would give rise to a legal action is a question mark. I suspect not but contacting the creator/writer might be smart.
What appears to be a greater problem for you is the use of "Satchmo" to identify a trumpet-carrying monster. You will want to contact the
Louis Armstrong Educational Foundation, Inc to discuss permission to use the Armstrong's nickname in your video game. The Foundation holds personality/publicity rights to Louis Armstrong material (including name and images).
