To ask the question(s) I need to give a brief rundown of the entire story, so here goes: In March I was at home waiting for a friend to bring me his computer to work on, I had recently lost my job and could have used the money. After waiting an hour for him to show I text msg'd him to ask if he was coming or not. I rec'd a reply that told me to come there. This was at about 12:30AM. I have an 11 yr. old son, he was asleep on the couch. I thought I was just going to pick up the computer, and since my son and I had been alone since he was 4 and since he is a very bright and responsible child, I left after securing the house - putting his cell phone beside him - writing him a note in case he awoke, etc. (I know that I should not have left, but I thought I would only be gone for no more than 20-30 mins. and I really could have used the PC Repair billing). Anyway, it was not my friend that text me, it was a police officer that had just arrested my friend. They unlawfully detained me when i arrived and eventually arrested me when they felt I was not being cooperative (misdemeanor possession was charge). I told them as soon as I realized I was not going back home that my son was home and I needed them to send someone to go be with him as he could not wake up alone. The officers waited 2.5 days to press charges, so I sat in jail for that long not even being processed in (got booked while I was bonding out). Those charges have been dropped. I was found "guilty" of neglect and/or abuse due to lack of supervision.
Question 1 - I told them, basically turning myself in, how can I be found neglectful? I never would have left my home that night had the officer not "impersonated" my friend.
Since that fateful night, besides charges being dropped I have also attended (and still am) a drug rehab facility, gotten two part-time jobs which I work, helped the police as much as possible with a complete statement regarding my knowledge of ONE individual - dealer. I have had a poem published and received the Editor's Choice Award. I have never been in trouble before in my life and therefore have a clean record. They awarded temporary custody to my son's Aunt and he has been living in Indiana since Mid-March.
There are guidelines to be followed which have not been followed. They will not give me a permanency plan. They do not believe anything I say. My son's CASA person talks to his Aunt and not him. His Aunt has now forbade me to call him. A lie was told about my fiance "beating" me and they refuse to believe me about that. i was raised upper middle class, I am not like the other people that they are comparing me to.
Question 2 - have my parental rights been violated?
Question 3 - they now state that I cannot have my fiance with me, although he has a legal right to be at our residence due to him being on the Purchase Agreement we signed last year. The Judge flat out told me that I will not get my son back if I have my fiance at the house. (we had broken up briefly, but are trying to work things out - we have been together for more than 6 years). Can they make this demand?
any help/advice would be greatly appreciated. my son wants to come home and his miserable at his Aunt's. I desperately need to get him back home where he belongs.
