Race determine custody???

Hello, my wife and I have been married for 9 and half years. We have a 29 month old daughter with special needs (cerebral palsy, siezures, 2 brain surgeries, 1 heart surgery). We are now involved in a divorce. We have been living here in Ohio for about 18 months and her last brain surgery was done right here, all of her medical records are now right here and her doctors and therapist are right here. The only dispute in our final hearing of the divorce was that my wife wants to move back to Floridia and take our daughter. I dont want to take our daughter away from her but I want to keep my daughter right here. We are an interracial couple with me being white and her being black. During the final hearing, the court determined that we are both very involved and fit parents who have been there for our daughter from the beginning. The twist is that the magistrate who heard our case is a black woman who has been heard, out of court, in the past saying that a white family should not be raising up a black child. If a child has 1 drop of black blood in them then they are "black". We are still waiting on her decision. SHOULD SHE BE ABLE TO BASE HER DECISION ON THIS? Also, my soon-to-be exwife stated in court that if the court says that our daughter remains here in Ohio than she will be leaving anyway by herself. This whole thing just doesn't seem right.

Legally...NO. She cannot base her decision on race. She can only base her decision on facts. If your very involved with your daughter and so is the mother I don't see why they would allow her to take your daughter anywhere especially when there is medical necessities. Sounds like mom is only thinking of herself, not the child at all if she's willing to leave the child there with you whether the courts say she can move or not.
