racial slander - need advice

my husband has ran a soccer camp for 25 years and has always ended with an allstar game. this year he did the same, he verbally invited 40 young athletes to participate on the last weekend in october. of the 40 verbal invites, 36 showed up and played. 1 of the 4 no-shows is african american and has accused my husband of not calling because they are black. my husband did not call one other participant. the parents of this young girl have put in writing that this was the reason - numerous families have explained to them that no one received a call, but they do not believe this and continue to slam his reputation. do we have a civil suit for slander and defamation? and what do we need to prove in a court of law?

Slander involves FALSE statements (i.e. lies) that are broadcast to an audience and as a result, damages are suffered.

What damages has your husband suffered?

If they honestly believe (i.e., you stated that they do not believe no one received a call) that they did not receive a phone call because of their race, how do you plan to go about proving that they are deliberately making false statements (i.e. that they are lying)?

he received in writing a letter stating that the family believes it was racially motivated - this letter was also sent to the board of the local soccer organization. the board then had a lawyer investigate and found no basis for the accusations. as for damages, only time will tell his financial damages, as for his reputation, it is tarnished because of a false accusation. the organization had to pay for the legal investigation.

Since the board has found no evidence to support their accusations, and since at this time you can't point to any specific damages, you'd do well to let it go, at least for now. It's extremely difficult, if not impossible, to put a slander case through when it's based on someone's opinion.

What I'm saying is that if it is the family's honest opinion that this was racially motivated, it's not slander, even if they are wrong and you can prove it.

If at some time in future you are able to point to some specific damages AS THE LAW SEES DAMAGES and say there, that wouldn't have happened if not for their accusation, that will be time enough to look into lawsuits.

Tell these idiots that if they got off welfare, quit having babies so they could afford a phone and cut the damn 'fro they might have gotten a call.
