What is the name of your state (only U.S. law)? California. I am a retired railroad worker since 1988. I received a railroad retirement annuity until April 2005. The Railroad Retirement Board issued a letter in May of 2005 stating that my annuity would be suspended due to non cooperation and exceeding my earning limit of $400 per month.

In January of 2005, I issued a letter to Railroad Retirement stating that I wanted to cease my annuity due to gainful employment and that I would be exceeding the $400 per month cap on earned income. They are stating that My earnings exceeded the maximum amount I would earn during the year which was $4999.00.

Railroad retirement states that according to Social Security, I earned $6290.00 in 2005, I agree with this figure. I am at a loss as to how to address the RRB and their claim since I informed in January of 2005 that I wanted to cease my annuity because of employment earnings exceeding the $400.00 per month income limit.
