I have been employed by the same company as manager for better than 20 years. Recently our company has decided to build a new restaurant that will be bigger. Since then all of my bosses have been questioning my ability to run this new restaurant when it is built. I injured my elbows and my back basically due to wear and tear of doing this work and some repetitive work over the last twenty + years. I let my boss know that I was having some physical therapy on my arms because the tendons are swollen. Since then He has been constantly asking me if I am going to be able to hold up to the vigors of business in the new store. He says it seems that I am falling apart physically. Recently, I had to deal with an Assistant that was having sexual relations with one of the other employees significant other while they too were working. This employee that was reprimanded has been calling my boss complaining about her hours, saying that I am treating her badly. Anyway, She is supposed to work 40 hours a week but because of her sleeping with one of the employees boyfriends, I can not work them on the same shift which limits the hours available for her to work and she has requested 2 days off as well. My boss told me that if I can not work her around all this and give her hours then He would have to take over scheduling for me. I think that now that My physical health is not that of a younger person, I think he is trying to weed me out. Is this harassment or discrimination?

From your post it doesn't even register that discrimination or harassment has happen as defined by the law.

It does appear that your boss is questioning whether you can perform the essential functions of your job though and he certaintly has the right to do that.

One thing I forgot to mention is that two senior Managers, that had been with the company for twenty+ years have already been terminated. I am the last with this much longevity. With those two gone, I am now the highest paid manager. This company has been talking a great deal about profit being down in all stores. An easy way to combat this is to replace high paid senior managers with new managers which will be paid less.
