About 2 years ago I was visiting my bro out of town at a party at his house. The next morning a girl claimed her underwear was missing and pinned me as the suspect. Several people cried rape, including her, I was harassed by her and her family, by police for some time. During this time word got around, I lost respect from my family, was fired from my job and lost my girlfriend (quite a bit of emotional distress, I had several things go wrong all at the same time). Eventually the police just kinda gave up, I don't really know why. I would assume it had something to do with the fact that the girl was trying to get any guy she could that night. I never even had sex with her or was willing to. So what can I do? Have I waited too long?

How much did the other things play in you losing your job, girlfriend, etc?

the issue with my girlfriend was totally separate, with work i think it had quite a bit

Do you mean several people claimed to have been raped or several people claimed SHE was raped? Did she accuse you of raping her or not? What do you mean the police were harassing you?

Did she go to the hospital for a phyical examination? If so, was there any evidence to suggest you had been physically close to her? Was her blood checked for alcohol or drug levels?

You can't really prove you did NOT rape or assault her, but the absence of certain things usually tips the scale in the favor of the suspect.

Did you have ANY close contact with this girl that night?

she was the only one who was 'raped' (if she really was) that night, so people were blaming me, it wasn't several incidents. she went to the hospital and had been told she was raped, and police wanted me to have my DNA checked to see if it matched. i have no idea about her drug or alcohol levels (but from what i could tell she was obviously drunk or more). i didn't have any close contact with her that night. the reason i was blamed was she had been passed out in a room, and i was in the room using the phone (i wanted to get somewhere quiet so i could have a conversation), and some people came in and told me to get out of the room.

You mentioned the police wanted you to take DNA testing. Well...DID YOU? The only reason I can see police harrassing you is because they were asking you to take a DNA test and you were refusing, not cooperating, etc -- all reasons you would be a "person of interest."

If you truly did not rape her, let alone touch her, then you wouldn't have anything to worry about. You would've been cleared. Why wouldn't you want to clear your name immediately if you didn't do it?

no, my lawyer told me not to take any DNA testing or to answer any questions, unless I was legally required to do so.

Then why are you asking us quesitons here? If you insist that you did not have sex with this girl, why withhold the DNA that could clear you if you have suffered job loss as a result and have nothing else to fear? Perhaps, you may have raped someone else or comitted some other crime where your DNA might match?

So only bad guys have/need/use civil liberties? That's one of the most insidious, dangerous notions around. If good people don't assert their rights under the law, the assumption will soon be that the every person who asserts his or her rights is up to no good.

The most basic right in the criminal justice is "innocent until proven guilty beyond a reasonable doubt." Has that also been "proven quaint" like the Geneva Convention?

To the OP - You'd have a tough time proving defamation this late in the game. Sorry you had such a rough time.
