We are very concerned about possible health issues that could be caused by having constant exposure to rats and their droppings. We are living in a condominium in San Antonio, Texas that has been infested by rats; just recently (02/12/01)the property has ordered more pest control visits to try to control the situation and tend to our verbal complaints - the problem was initially reported in August, 2000.

Since 2/12/01 there have been 13 dead rats caught, and there are still more in our condominium. We know this because we hear them, smell them, and have seen them running around in our "home". One has gone as far as jumping on my husband. We feel this is an unsanitary environment - are we overreacting?

We are trying to get out of our lease without a penalty, but have had trouble getting an approval from the owner. We have spoken to him and have served him with a registered letter requesting the same (per their contract procedures). The neighbors have caught 3 dead rats on their side and have been released from their contract. Can you help us by providing information that helps support our concerns? Can we break the lease without a penalty? Can we have the property assist us with moving expenses since we hadn't planned on moving until our lease was up in November? Should we seek legal representation?
