hi everyone
I tried to set up monthly payments with an attorney collection agency re the debt I owe on capital one credit card( is owed 5000.00) and I sent them a money order registered mail and they sent it back today. They did not enclose a letter telling me they refuse the payment, but they only placed a post-it attached,(stating no attorney of record. Previously I had called the courthouse here in san diego to find out if their was a judgement filed and they said no only a summons complaint, so I had a letter sent to them by a pre-paid legal stating my wishes to make monthly payments and then I sent them a money order for the amount of $150.00. registered mail and return receipt. I am puzzled??? I thought the goal was to establish monthly payments to resolve the credit card debt. I don't understand why they sent it back to without considering monthly payments. I don't know what recourse I should take now!!! DO I continue every month senting the same money order and the amount since that's all I can afford at this time? Or do I file a chap 13 to align all my debt? Do I seek legal repesentation? Or do I file legal complaint against the attorneys since I trying to resolve my capital one credit card debt and I have other credit who have agreed to work with me.
Please let know if anyone out there can help and give me some good advice on what to do next!!!

I am being sued by capitol one with an attorney debt collector also. When I received the summons the server told me she got sued also and not to feel bad. anyway, I reviewed the complaint and realized that the numbers don't match my card. I responded to the complaint and asked for my debt verification, as I was never given the opportunity to do so, and this is not my card. I also accused capitol one of various unfair billing and collection practices. Since then I received a letter in the mail saying they want to settle. Respond to the complaint, and answer the accusations or you will be in default and they will get an automatic judgement on you for the entire amount plus costs and attorney fees. Sucks to owe money, sucks more to pay money you don't owe, and costs you shouldn't have.

IF I am reading this right, you did create the debt in an agreement.
An agreement is a two way street.
If you want to establish a payment plan, try ASKING the other party to accept it.
Do not presume to tell them what you will pay and how you will pay it on a take it or leave it basis. You would be insulted and feel abused if someone did this to you with what is essentiall YOUR money (owed to you) so don't be so surprised if they reject your 'offer' when it seems like you are imposing a demand that they must comply with.
Get on the phone immediately with them, (in person shows even more good faith and demonstrates that you REALLY are sincere) - and ASK them if they will agree to your payments plan.
Don't just slap them with a 'like it or lump it' situation.
Remember, they may not see the same things in your actions that you do! ;)
