I am planning to sue an individual who hit my car on private property located in Arizona. The driver who hit me is here illegally and has no papers. He borrowed his girlfriends car. Do I list the driver as a defendent even though he has no papers, or do I list him and his girlfriend as defendents.

My response:

You sue them both. You sue him because of his negligent driving, and you list her because of her "negligent entrustment" of her car to him. You need to sue both, because each Cause of Action is dependant upon the other.

For example, if you don't sue him, how would you be able to "connect" her "negligent entrustment" of her car to someone that isn't being sued ? The cause of action against her is dependant upon your cause of action for negligence against him.
