I started the post begining of a nightmare...my nightmare has just ten-folded itself!

I came home from grocery shopping and dropping off my middle child at her friends and found a sherrif in my house! He was here to serve me papers to go to court tomorrow. They are going to try to take my daughter away from me because I didn't take her back for a second set of tests. I took her a few years ago and the nueologist said that her shaking was minimal and that she would outgrown it. The testing they did came back normal. (a dye injected cscan or MRI...forget which exactly). My daughter had a very difficult time at staying under (they gave her enough stuff to knock me out for 10 hours). But they got enough of the test to say they didn't see any abnormalities. I never got a copy of the files...who does that? I signed a paper for the school to do it last year, and again this year because they were unsucessful after they tried without my permission...

Then this year came along, the teacher tells my daughter she smells, has a boy pull her pants down...nothing ever came of that...she brings home her re[port card.A's-B's and one D in reading..all fairly good grades...not all A+'s at all...she's learning still...if she was getting all A's that would tell me she doesn't need special ED and of course she does...

So tomorrow, I have to appear, along with my ex husband, in county court. I am completely.utterly disgusted by this school...I would never avoid going back to the DR if I felt she had a serious problem...ever. I don't see her shake at home...very little (only if her and her sister are fighting...her sister is twice her size!) I don't know what to expect or what to do...I'm a mess....I did save every letter, and all her school papers. There is an obvious improvement from one year to the next all the way around. Do they have the right to try to take my daughter from me for this? What can I do tomorrow to help myself?What is the name of your state?

Get off of the INTERNET, Get ALL of your paperwork together, and tell the truth.

I find it hard to believe that your were just notified TODAY to appear in court TOMORROW!!! :rolleyes: :rolleyes:

no, this is exactly what happened. I have all the papers I mailed, I have all her report cards (which are good too). They say she shakes so bad she can't do her work...she shakes so bad that she hurts herself tripping...she doesn't...she is an average kid that is a little slower than other kids, and really she isnt that behind.

All of this happened 1hr 30 mins ago...and I only checked here because I happend to look at my emails and saw someone had asked me how it's going from this forumn...I am beside myself and thought it would help to post.

If you have to appear tomorrow, then this is an emergency hearing! Why would you not get your child re-checked? It would only benifit her.

I'm sorry, if she is shaking that bad in school and not at home, then you are not telling everything.

The only time she ever shakes is when she is scared, or nervous...they make her sit by the boy who pulled her pants down...so yes she is going to shake.
Her problems started when she was a baby and her eyes shook then it moved into her head...then into her hands, and at the time the nueologists said she would outgrow it...now a couple of years later she hardly shakes at all exceopt when like I said she is scared OR nervous. She can write, she can play normal, she can run normal, she can do everythign like anyone else. I have 3 kids and she is my youngest...I have not done anythign different with her than the other 2. I am rightfully upset about tomorrow and was just looking for support. I do feel this is an abuse of the system...and after reading these court docs more carefully..through the tears....I am going to guess the judge will expect to see a child who can't walk, talk, or anything on her own and that I am ignoring her "nurological need"...I am not and have never ignored it and have seen so much improvement over the last 2-3 years that I believe she is improving...and I have all her work saved to prove it.

AGAIN! Why didn't you just get her re-checked? That would seem to have been the easy thing to do considering she is so bad in school. I have never seen anyone shake the way you have described because they were scared.

Although I agree that the child should get checked out again.....I disagree with the statement above about never seeing anyone shake uncontrollably out of fear.

I am an 8th degree black belt in Karate. I use to (and sometimes depending on the stress) shake and tremble uncontrollably when confronted with my opponent. Adrenaline plays a huge role in this. In my case I have learned to control it (most of the time).

Adrenaline flows quite predominately when a person is nervous or scared and can be the culprit of a number of physical reactions ( including uncontrollable trembling and shaking)...no matter the age of a person ( sometimes called an anxiety attack).

It could also be a reaction/symptom of many other disorders.

OP>..Please have the child checked out again!

I am not the person saying she shakes...she never shakes at home unless she is fighting with her sister (who's a year older) and she gets mad at her....that's it-i have not ever witnessed her shaking out of control-even when it was at it's worse. That's the whole problem here. If I felt my daughter needed medical care, I would do it immediately. I was asked to sign over approval of the school to charge medicaid for her occupational therapy at the beginning of the school year, and other approvals (I did, except for the medicaid part)...I was the person who requested she get extra help, and also the person who sought a nuro in the beginning....when the DR told me she would outgrow it, I believed her- the testing they did was normal...and I see a big imropvement so I can say seeing is believing. The teacher she has in the regular room is who I am having difficulties with. She is with her 1 hour a day. The rest of her day is either in gym, music, etc, or the special ed room. There is no more to this than that...I of course will do whatever they (the court) request of me....I was planning on finding a education DR to get her a new IEP drawn up because hers is so vague....but now I am considering pulling her out of that place completely and home schooling her the rest of this year....and possibly moving. I have known people that shake, and people who are handicapped, and have NEVER seen a school teacher tell their parent what to do about it...and never point at the child announcing whatever it is they feel like...from "you smell" "your not doing it right" "I don't like your hair like that" etc...they should be focused on her education, building her self-confidence instead of pointing out her weakness. They should have also punished the boy who pulled her pants down, and they should have also moved him permanatly across the room, instead of putting him right next to her.

All the people I know who had shaking problemsm turned out great. None of them had a nuro to turn to, to be put on meds, etc. But they also had teachers who focused on thier strengths.

I sat my daughter down tonight and had to tell her what could possibly happen tomorrow....I told her that her dad and I will be there, and that we will do all we can.
She said "mom, if they just want me to go to the DR again, I will go and not cry when they make me sleep, or when they give me the shot." I tell you all again, if I felt it was necessary, for her well-being-I would have done it....now I am going to have a court tell me I have to do it and just don't feel it's right....and then again, the judge may look at my daughter and see I am right. I have several school papers from K up to now..2nd grade, to show him there is a huge improvement. I did print out part of IDEA. And from what I have read, if it's not written on her IEP, they shouldn't be able to do half of what they are....

So yes, I am going to have her rechecked....I am going to give the bill to the school, and I am going to let the tests show that I am right. I feel this is a waste of money...and feel that whatever the tests show won't stop her shaking in school if they don't change her surroundings and give her a harassment-threat free space to do her work.

Nothing in your story makes sense to me. It is only my opinion, but that is how I see it.
