There was an extremely miniscule possibility he was not bio dad, but as he has grown family resemblance is just to strong to his half brothers to make it otherwise.
I was young and naive when son was born, and when bio asked me to list him unknown because he had been separated for over a year but divorce was being held up by a custody issue re: another child, I did. Stupid me.
Later, I also believed him when he said that he would not have to pay child support because child is disabled and receives SSI, so I never pursued it.
I have almost hoped he would apply for paternity so we could settle this once and for all, but he has shown no interest tho he lives 4 blocks away.
I am just mainly concerned about custody of my son because I am ill,and he is disabled and they know zero about how to care for him while step-dad has been involved for over 3 years and knows what hs needs are. Any advice?

My response:

File in court, like I said. The bio father will be ordered to submit to a paternity test. If he fails or refuses to comply, the court could, on its own motion, terminate all potential bio-father's rights and allow an adoption. The bio-father can't claim something he refuses to acknowledge as his, or failing to cooperate in making that determination. See your attorney for further details.

With UNKNOWN on the birth cert can she not just proceed with the step father adopting the child ?. If that can be done then the bio father who does not seem to care, would have a big fight on his hands to win the child back.. something he is very unlikely to do... ????

Here in NC, the only way the step-father could EASILY claim he is the father, is if the mother had never been married before. Otherwise, my understanding is....he would have to prove he was the bio-father, and go through the tape.

**Just my understanding, no proof in the puddin...hehe**
